Terms of use

1. Your licence to play

We give you a personal, non-exclusive, non-transferable and revocable licence to install the game from Google Play and play it for your own non-commercial entertainment. The game, its art, music, code and content remain ours or our licensors'. Open-source components and their licences are listed in the game under Settings › About › Open-source licenses.

2. Age

The game is intended for players aged 16 and older. Younger players may only play with the permission of a parent or guardian, who accepts these terms for them.

3. Your account

• The game creates a guest account on the first start. It is tied to the phone: if you uninstall the game or change phones without linking Play Games, your captain cannot be restored.
• You can link your captain to Google Play Games in Settings › Account to restore it on another device.
• One captain belongs to one person. Do not sell, share or transfer accounts, and do not use another player's account.
• You can delete your account at any time (Settings › Your data › Delete account, or see our account deletion page).

4. Virtual items and currencies

Gold, wood, fish, scrap, reputation, cosmetic items, boosts and every other item in the game are part of the licence to play. They have no cash value, are not your property, cannot be exchanged for money or real goods, and cannot be sold or transferred to another captain or another person, inside or outside the game. We may change, rebalance or remove game content and in-game prices to keep the game fair and fun; we do not remove items you bought with real money, except as described in sections 5 and 10.

5. Purchases

• The game is free to play. Some items can be bought with real money. All purchases are optional, are one-time purchases (no subscriptions) and are processed by Google Play under the Google Play Terms of Service. Prices are shown in Google Play before you pay.
• A purchase belongs to the captain it was bought for. It cannot be moved to another captain, also not after you delete your account and start a new captain.
• If a payment is pending, the item is added once Google Play confirms it. Shop › Restore purchases asks Google Play again for purchases of your captain.
• Refunds are handled by Google Play according to its refund policy (Google Play refund help). If a purchase is refunded or charged back, we remove the item from your captain and take back the resources it gave, as far as they are still in your port storage. If some were already spent, that product is not sold to the captain again.
• No item you can buy gives combat stats, and bonuses from purchases and ads never count toward ratings, loot or leaderboards in battles between captains.

6. Right of withdrawal (consumers in the EU and the UK)

As a consumer you can usually withdraw from a contract concluded online within 14 days without giving a reason. For digital content that is not supplied on a physical medium, this right ends once the supply has begun with your prior express consent and your acknowledgment that you thereby lose the right of withdrawal.

Items bought in the game are delivered to your captain immediately after Google Play confirms the payment. By completing a purchase you ask us to deliver the item immediately and acknowledge that you lose your right of withdrawal once the delivery has begun. Where this consent was not validly given, you may withdraw within 14 days of the purchase by telling us clearly, for example by e-mail to 0ndr4N@proton.me with your Support ID and the Google Play order number. We then refund the payment and remove the item.

7. Rewarded ads

Some bonuses can be earned by watching an ad. Ads only play after you tap their button, and the reward is shown before you start. The reward is granted after Google confirms to our server that the ad was completed. Daily limits apply. Ads are provided by Google AdMob; we do not control their content but request ads suitable for the audience of the game.

8. Fair play

You must not:

• cheat, use bots, automation, modified clients or tools that change the game or its traffic;
• exploit bugs on purpose, or use several accounts to gain an advantage (for example to feed wins to another captain);
• attack, overload or reverse engineer our server, or try to access data that is not yours, except as far as the law allows this despite these terms;
• buy, sell or trade accounts or items for money.

Our server checks game results automatically. Results that look implausible may be held back from rewards and leaderboards and reviewed. If we find a breach we may remove the unfair gains, exclude a captain from rankings or battles between captains, or suspend or close the account. We tell you why, unless the law or an investigation prevents it, and you can contest the decision by writing to us. Before closing an account for good we consider the seriousness of the breach.

9. Battles with other captains

You can challenge the ships of other captains in the risk zone. Those ships are steered by the game according to their real strength and the tactic their captain chose; their captain does not need to be online and gets a report afterwards. Captain names are generated by the game (adjective, noun, number) and there is no chat, so players cannot send each other messages. The game also shows computer-controlled rival captains, which are clearly marked. A captain who beats your ship can take a limited share of your unprotected fish, wood and scrap, never gold, bought items or cosmetics. The rules are shown in the game before you enter the risk zone.

10. Availability and changes

• The game needs an internet connection. We try to keep it available but cannot guarantee uninterrupted service; maintenance, updates and outages can happen.
• We develop the game further: we may add, change or remove features and content, and an update may be required to keep playing.
• We may change these terms for valid reasons, such as new features, legal changes or to prevent abuse. We announce important changes on this page at least 30 days before they take effect. If you do not agree, you can stop playing and delete your account.

11. End of service

We may end the game. We announce this in the game and on this website at least 90 days before the servers are switched off and stop selling items from the announcement. When the service ends, your captain, its progress and all virtual items end with it. Items bought with real money within the 90 days before the announcement are refunded on request.

12. Liability

The game is provided free of charge "as is". We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and wherever mandatory law does not allow a limitation. Otherwise, as far as the law allows, we are not liable for indirect damage, lost profits or the loss of virtual items or progress. Your statutory rights as a consumer, including the legal guarantee for digital content you paid for, are not affected.

13. Governing law and disputes

These terms are governed by Czech law, excluding its conflict-of-law rules. If you are a consumer living in another country, you also keep the protection of the mandatory consumer laws of that country and may take legal action there. Please contact us first; we try to settle every problem quickly. If we cannot agree, consumers may also use out-of-court dispute resolution at the Czech Trade Inspection Authority (Česká obchodní inspekce), coi.gov.cz.
